Are you prepared for the new tobacco legislation? Keep It Out are providing essential guidance to help law-abiding retailers safeguard their businesses, stay compliant, and protect local communities from organised crime. Here is what you need to know as a retailer to operate on the right side of the law and avoid severe penalties.
Major age-of-sale changes from October 2026
From today (29th October 2026), selling any vaping or nicotine product, including nicotine pouches and non-nicotine vapes, to anyone under 18 becomes strictly illegal. This regulatory change also bans proxy purchasing (i.e. adults purchasing tobacco products for minors), promotional discounts, and free product distribution, alongside tighter restrictions on vending machines.
The Smokefree Generation law arrives in 2027
From 1 January 2027, retailers cannot legally sell tobacco products, herbal smoking products, or cigarette papers to anyone born on or after 1 January 2009. As a shopkeeper, you must verify birth dates and display updated point-of-sale signage declaring: "It is illegal to sell tobacco products to anyone born on or after 1 January 2009."
High costs of non-compliance and illicit sales
Failing to follow age-verification rules or dealing in illegal tobacco (i.e. illegal whites, counterfeit tobacco, or non-UK duty paid tobacco stock) carries heavy penalties. You can face fines up to £20,000, criminal prosecution, and loss of alcohol or lottery licences. Ensuring your business holds an Economic Operator ID and meets track and trace requirements keeps you protected.
Protecting profits and local communities
Rogue traders selling cheap, illegal tobacco undercut legitimate sales from retailers like you. And even more damaging for local communities, they fuel organised criminal gangs. By staying legally compliant, you can protect your commercial reputation, help shield local children from smoking, and ensure public tax revenues support vital community services.
To ensure you stay prepared for upcoming tobacco legislation, prepare and educate yourself and your staff on these upcoming changes, update store signage, and report suspicious sales or vendors. You can do it 100% anonymously by calling Crimestoppers on 0800 555 111 or by visiting keep-it-out.co.uk/anonymous-reporting.
